By accessing or using the GalSol platform, you agree to be bound by these Terms of Service ("Terms").
1 Service Description
GalSol provides automated workflow tools, including certificate generation, bulk emailing, Mini Site building, and event registration forms (GS Forms).
2 Account Registration & Security
To use GalSol, you must authenticate via your Google Account.
- Age Requirement: You must be at least 12 years old, or the age of legal majority in your jurisdiction, to form a binding contract.
- Account Security: You are fully responsible for all activities that occur under your Google account. You must immediately notify us of any unauthorized use of your GalSol workspace.
3 Acceptable Use Policy STRICTLY PROHIBITED CONDUCT
GalSol provides powerful publishing and mailing tools. You agree that you are solely responsible for the content you create, host, or email using GalSol. You shall NOT use GalSol to:
- • Phishing & Fraud: Create forms or Mini Sites designed to deceive users into providing passwords, financial data (credit card numbers, bank details), Aadhaar/SSN numbers, or other sensitive credentials.
- • Spam: Send unsolicited bulk emails (spam) in violation of the CAN-SPAM Act, GDPR, or Indian IT Act guidelines. You must have explicit consent from recipients before emailing them.
- • Illegal Content: Host or transmit content that is defamatory, obscene, pornographic, promotes violence, violates intellectual property rights, or is otherwise unlawful under Indian law.
- • Impersonation: Impersonate any person or entity, including GalSol, Google, or any government agency.
Enforcement: GalSol reserves the right to employ automated scanning and manual review of public forms/sites. We will immediately suspend, block, and terminate any account found violating these rules, and we will report illegal activities (such as phishing) to the relevant cybercrime authorities.
4 Creator Responsibilities & DPDP Act Compliance
When you use GS Forms or the Mini Site builder to collect data from individuals, you act as the Data Fiduciary under the Digital Personal Data Protection Act, 2023 (or the equivalent Data Controller under GDPR). GalSol acts merely as your Data Processor.
By collecting data using GalSol, you legally agree to the following strict obligations:
- Mandatory Consent: You must obtain clear, affirmative, and itemized consent from respondents before collecting their personal data.
- Providing Notice: You must provide a clear notice to your respondents detailing what personal data is being collected and the purpose for its processing. You must include a link to your own Privacy Policy on your public-facing GalSol forms.
- Entry Pass Disclosures: If you enable the GalSol "Entry Pass" feature, you explicitly authorize GalSol to store your respondents' Name, Email, and Pass Token on our servers. You are legally required to inform your respondents that their ticketing data is being processed by a third-party platform (GalSol) for access-control purposes.
- Data Principal Rights: You are solely responsible for responding to your users' requests to access, correct, or erase their data.
- Liability: GalSol shall not be held liable for your failure to obtain legal consent from your respondents. You agree to fully indemnify GalSol against any legal action, penalties, or fines levied by the Data Protection Board of India resulting from your misuse of respondent data.
5 Intellectual Property Rights
- Your Content: You retain all ownership rights to the text, images, logos, and participant data you upload or create using GalSol. By using the platform, you grant GalSol a limited license to host, copy, and display this content solely to provide the Service to you.
- GalSol's Property: GalSol retains all rights, title, and interest in and to the platform, including its code, design, UI/UX, and AI integrations. You may not copy, modify, or reverse-engineer any part of the GalSol software.
6 Service Quotas & API Sending Limits
GalSol connects directly to your Google Workspace to send emails and generate files. To protect the integrity of the platform, prevent spam, and comply with Google's API thresholds, GalSol enforces strict daily usage limits.
- Standard Gmail Accounts (
@gmail.com): Restricted to sending a maximum of 100 emails per day via the GalSol platform. - Google Workspace Accounts (Custom Domains): Restricted to sending a maximum of 1,000 emails per day via the GalSol platform.
Important Considerations Regarding Limits:
- Google's Absolute Limits: While Google’s theoretical limits are higher (500 for standard, 2,000 for Workspace), GalSol artificially caps these lower to prevent fraud, account suspension, and API abuse.
- Account Suspension: Attempting to bypass these limits using multiple accounts or exploiting the system will result in an immediate, permanent ban from GalSol.
- No Liability for Halted Campaigns: GalSol is not liable for any delays, halted campaigns, or business losses resulting from you hitting these daily sending limits or if Google independently suspends your account for violating their spam policies. By bypassing the Google "Unverified App" warning screen, you explicitly trust GalSol to execute your requested automated campaigns subject to these restrictions.
7 Unverified App Status & API Limits
By bypassing the Google "Unverified App" warning screen, you explicitly trust GalSol to access your designated Drive, Sheets, and Gmail data for the sole purpose of executing your requested automated campaigns.
GalSol is not liable for campaigns halted due to Google Workspace rate limits or suspensions of your Google account due to your own spam violations.
8 Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GalSol expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
9 Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall GalSol, its affiliates, directors, or employees be liable for any indirect, punitive, incidental, special, or consequential damages, including without limitation damages for loss of profits, goodwill, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this service.
10 Indemnification (Protecting GalSol)
You agree to defend, indemnify, and hold harmless GalSol, its creators, and affiliates from any claims, damages, obligations, losses, liabilities, costs, or debt arising from:
- Your violation of any term of these Terms of Service (especially the Acceptable Use Policy).
- Your violation of any third-party right, including copyright, privacy, or property right.
